Please read these Terms and Conditions ("Terms") carefully before using OzDeals. By creating an account or using the app, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use OzDeals.

For the purposes of these Terms, the following definitions apply:
By accessing or using OzDeals ("the App", "the Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and OzDeals, operated by [BUSINESS NAME] (ABN [ABN]), with its registered address at [REGISTERED ADDRESS] ("OzDeals", "we", "us", "our").
You must be at least 13 years of age to use OzDeals. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have obtained parental or guardian consent to use the App. OzDeals does not independently verify parental consent; however, we may request confirmation if we become aware of a potential violation of this requirement.
a) You may register for an account using your email address.
b) Email verification is required to access the full features of the App.
c) You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
d) You must notify us immediately of any unauthorised use of your account.
e) You may not share, transfer, or sell your account to another person.
a) Your username must be unique and comply with our character requirements.
b) Usernames must begin and end with an alphanumeric character and may contain underscores.
c) OzDeals reserves the right to reclaim, reassign, or require changes to usernames at our sole discretion, including usernames that are inactive, misleading, or infringe on trademarks.
You agree not to:
a) OzDeals is a platform for users to share, discover, and discuss deals. Comments, votes, reports, alerts and other contributions ("User Content") are created and submitted by users, as are most deals. Some deals are Automated Content: they are published by our automated OzDeals account, which aggregates offers already publicly available elsewhere. Automated Content is labelled as such in the App and is not submitted by any user.
b) You are solely responsible for the accuracy and legality of any User Content you submit.
c) OzDeals reserves the right to review, edit, remove, or restrict access to any User Content at our sole discretion, including content that violates these Terms or is otherwise objectionable.
d) Votes, saves, and other interactions with deals are recorded and may be used to calculate content visibility and user reputation.
a) In this section, "deal" includes coupon and promotional codes posted through the App. Before posting, you must verify that the offer is available to Australian consumers and that all applicable costs and fees, including shipping and taxes, are clearly disclosed in your post.
b) You must be transparent about your connection to the deal being posted:
Disclosure must be made in a clear and prominent manner within the deal post itself (for example, at the start of the deal description). Burying a disclosure within lengthy deal text is not acceptable.
c) The following types of deals and content are not permitted on OzDeals:
d) Violation of these posting guidelines may result in removal of your content and may lead to account restrictions or termination in accordance with section 17.
a) You retain ownership of the User Content you submit to OzDeals.
b) By submitting User Content, you grant OzDeals a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, transferable, and sublicensable licence to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with the Service.
c) This licence survives deletion of your account. When an account is deleted, User Content is pseudonymised rather than removed, and the licence continues to apply to it.
d) To the maximum extent permitted by applicable law (including the Copyright Act 1968 (Cth)), you consent to any act or omission that would otherwise infringe your moral rights in User Content submitted to the Service.
a) OzDeals features a reputation system where users earn points through positive community engagement, such as posting deals and receiving upvotes.
b) Reputation points contribute to tiered rankings that are displayed on your profile and throughout the App.
c) Achievement badges are awarded for reaching milestones in activity, content creation, and community participation.
d) A leaderboard ranks users by reputation and contribution.
e) Reputation points, tiers, badges, and leaderboard rankings have no monetary value and cannot be exchanged, transferred, or redeemed.
f) Reputation points and badges are calculated and awarded automatically by the platform based on community activity. OzDeals' determination of point totals, tiers, and badge eligibility is final.
g) OzDeals reserves the right to modify the reputation system, point values, tier thresholds, badge criteria, or any aspect of the gamification features at any time without prior notice.
h) Manipulation of the reputation system, including but not limited to self-voting through multiple accounts, vote trading (exchanging votes with other users), paying or incentivising others to vote on your content, or organising groups to vote collectively on specific content, is a violation of these Terms and may result in suspension or termination of your account.
a) Deals on OzDeals are either submitted by users or published as Automated Content by our automated account. Neither is verified, endorsed, or guaranteed by OzDeals: Automated Content is aggregated mechanically from publicly available sources and is not reviewed for accuracy before it is published.
b) OzDeals is not affiliated with, sponsored by, or endorsed by any retailer, brand, or merchant whose deals appear on the platform.
c) Deal prices, availability, and terms may change without notice. You are responsible for verifying all deal details, including price, availability, terms, and conditions, directly with the relevant retailer before making any purchase.
d) OzDeals does not participate in, facilitate, or take responsibility for any transaction between you and any retailer or third party.
a) The App contains links to external websites and services operated by retailers and other third parties. These links are provided for convenience only.
b) When you follow a link to an external website, you leave the OzDeals platform. Any transactions, interactions, or agreements you enter into with third-party websites are solely between you and that third party.
c) OzDeals does not endorse, control, or assume any responsibility for the content, products, services, privacy practices, or policies of any third-party websites or services.
d) Affiliate disclosure: Some links to external retailer websites are affiliate links. This means that when you click such a link, or make a purchase after following it, OzDeals may receive a commission or other compensation from the retailer, at no additional cost to you. These affiliate arrangements do not influence which deals are published, ranked, promoted, or displayed on the platform — deals are surfaced on their merits and through community voting and activity, regardless of whether a link is monetised.
a) The OzDeals name, logo, branding, visual design, and all associated intellectual property are owned by OzDeals and are protected by applicable intellectual property laws.
b) You may not use, reproduce, modify, or distribute any OzDeals intellectual property without our prior written consent.
c) Nothing in these Terms grants you any right, title, or interest in or to any OzDeals intellectual property.
d) Copyright and intellectual property complaints: if you believe that content on OzDeals — whether User Content or Automated Content — infringes your copyright, trade mark, or other intellectual property right, contact us at ozdeals.contact@gmail.com or through the in-app Contact Us form. Identify the content complained of, the right you hold, and how we can reach you. We will review the complaint and remove or restrict access to any content we determine to be infringing. Repeat infringers may have their accounts suspended or terminated in accordance with section 17.
a) OzDeals employs a combination of user reporting and administrative review to maintain community standards.
b) We reserve the right to take any moderation action at our sole discretion, including but not limited to:
c) Moderation decisions are made at our sole discretion and are final. We are not obligated to provide reasons for any moderation action. We will endeavour to provide reasons for significant actions (suspension or termination) where practicable. Users may submit an appeal through the in-app Contact Us form or, if their access to the App has been restricted, by email to ozdeals.contact@gmail.com, though we are not obligated to overturn moderation decisions.
a) Users may report deals, comments, and other users that they believe violate these Terms or community standards.
b) Reports are submitted in good faith and are final once submitted. Reports cannot be withdrawn or edited after submission.
c) Where a deal is reported as expired or no longer available by a sufficient number of distinct verified users, it may be automatically marked as expired. Automatic expiry is a community-moderation mechanism intended to keep deal listings accurate; it does not delete the deal or the author's User Content, and the deal's author is notified.
d) Abuse of the reporting system, including submitting false, frivolous, or malicious reports, is a violation of these Terms and may result in action against the reporting user's account.
a) With your permission, OzDeals may send push notifications to your device, including:
b) You can manage your notification preferences within the App's Settings screen or through your device's notification settings.
c) Disabling push notifications will not affect the core functionality of the App.
a) You may block other users to prevent their content from appearing in your feed and to restrict their ability to interact with you.
b) Blocking is reversible and can be undone at any time through the blocked user's profile.
c) Blocking does not guarantee that you will never encounter the blocked user's content in all contexts.
a) OzDeals reserves the right to suspend or terminate your account at any time and for any reason at our sole discretion, including but not limited to:
b) Users with restricted accounts may retain limited read-only access to the App at our discretion.
c) We are not obligated to provide advance notice of suspension or termination, though we may do so at our discretion.
a) You may delete your account at any time through the Settings screen within the App.
b) Account deletion is permanent and cannot be reversed.
c) Upon deletion, your profile information is permanently removed. However, User Content you have posted (deals, comments) will be pseudonymised rather than deleted, to preserve the integrity of community discussions and deal threads: your username and profile picture are replaced, while an internal account identifier remains attached to that content.
d) Certain records may be retained as required by law or for legitimate business purposes, such as moderation records.
a) THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
b) OzDeals does not warrant that the App will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
c) OzDeals is not a retailer, merchant, or deal provider. We are a community platform where users share and discuss deals.
d) Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted, or modified by agreement, including any right to repair, replacement, refund, or compensation for failures to comply with consumer guarantees.
a) To the maximum extent permitted by applicable law, OzDeals and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising from:
b) Our total aggregate liability for all claims arising out of or relating to these Terms or the App shall not exceed AUD $100 or the total amount you have paid to OzDeals in the twelve (12) months preceding the claim, whichever is greater.
c) Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded under applicable law, including the Australian Consumer Law.
You agree to indemnify, defend, and hold harmless OzDeals and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to:
You are not required to indemnify OzDeals for claims arising from our own negligence, wilful misconduct, or breach of these Terms.
These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts of New South Wales, Australia, for the resolution of any disputes arising under these Terms.
a) In the event of any dispute arising out of or relating to these Terms or the App, you agree to first attempt to resolve the dispute informally by contacting us at ozdeals.contact@gmail.com or through the in-app Contact Us form.
b) We will make reasonable efforts to resolve any dispute within thirty (30) days of receiving your written notice.
c) If the dispute cannot be resolved informally within thirty (30) days, either party may pursue resolution through the courts of New South Wales, Australia.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and OzDeals regarding your use of the App and supersede all prior agreements, understandings, and communications, whether written or oral. In the event of any conflict between these Terms and the Privacy Policy, these Terms shall take precedence for matters relating to user conduct, and the Privacy Policy shall take precedence for matters relating to personal data protection.
a) OzDeals reserves the right to modify these Terms at any time. The "Last Updated" date at the top of these Terms will be revised accordingly.
b) Your continued use of the App after any changes constitutes your acceptance of the revised Terms.
c) For material changes, we will make reasonable efforts to notify users through the App or other appropriate means.

In the event of a data breach that is likely to result in serious harm to you, OzDeals will notify you and the Office of the Australian Information Commissioner (OAIC) as required under the Notifiable Data Breaches scheme (Part IIIC of the Privacy Act 1988 (Cth)), without unreasonable delay.
